Our Digital Services are intended primarily for informational and e-commerce purposes. We enable you to inquire about the various services and events promoted or hosted by Fries B4 Guys. We may also provide links for you to purchase tickets through third party payment services, some of which are operated by a third party, not Fries B4 Guys.

Your use of these features and other content or services provided by third parties—including third-party links to other websites on the Internet—are not governed by these Terms of Use. You acknowledge and agree that we are not responsible for the availability of, or any content located on or through, any third-party site or service, or any use of your information by those third parties. You further acknowledge that any reliance on representations and warranties provided by any party other than Fries B4 Guys will be at your own risk. You expressly agree to hold us harmless for any claims of damage arising from any content, product or service provided by any third party or use of your information by those third parties. Your use of those third-party websites and services is subject to the terms of use and privacy policies posted on each site or service, and we encourage you to review those terms of use and privacy policies.

MODIFICATIONS AND INTERRUPTION TO THE DIGITAL SERVICE

We reserve the right to modify or discontinue all or any portion of our Digital Services with or without notice to you. We will not be liable if we choose to exercise this right. You acknowledge and accept that we do not guarantee continuous, uninterrupted or secure access to our Digital Services, or that operation of our Digital Services will be uninterrupted or error free. 6. promote or distribute any unauthorized advertising, promotional materials, or material which can be characterized as “junk mail,” “spam,” “chain letters,” “pyramid schemes,” or similar material, any request for or solicitation of money, goods, or services for private gain, or any information posted primarily for advertising, promotional, or other commercial purposes;
7. disrupt or interfere with the security or use of the Digital Services or any websites or content linked to them;
8. interfere with or damage the Digital Services, including, without limitation, through the use of viruses, Trojan horses, harmful code, denial of service attacks, packet or IP spoofing, forged routing or email address information or similar methods or technology or disobey any requirements, procedures, policies, or regulations of networks connected to our Digital Services;

13. engage in any activity that interferes with any third party’s ability to use or enjoy the Digital Services; or
14. assist any third party in engaging in any activity prohibited by these Terms of Use.

Further, without our written consent, you may not:

1. reproduce, duplicate, copy, sell, resell, or exploit for any commercial purpose any Fries B4 Guys content or any use of or access to the Digital Services;
2. use any high volume, automated, or electronic means (including, without limitation, robots, spiders, scripts, or other automated devices) to access the Digital Services or monitor or copy our web pages or the content contained thereon;
3. deep link to the Digital Services for any purpose; or frame the Digital Services, place pop-up windows over any content, or otherwise affect the display of the Digital Services.

DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, FRIES B4 GUYS, THEIR RELATED ENTITIES, SERVICE PROVIDERS, LICENSORS, AND RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES OR AGENTS (COLLECTIVELY THE “COMPANY PARTIES”) EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, RELATED TO OUR DIGITAL SERVICES.

THE USER EXPRESSLY ASSUMES ALL RISK AND DANGER ARISING FROM OR INCIDENTAL TO THE USE OF THIS DIGITAL SERVICE, WHETHER SUCH RISKS OCCUR PRIOR TO, DURING, OR SUBSEQUENT TO THE ACTUAL USE OF THE SERVICE THE USER EXPRESSLY RELEASES THE EVENT FACILITY, LANDOWNERS, MANAGEMENT, PROMOTERS, PARTICIPANTS, PERFORMERS, ARTISTS, AND THE TICKETING AGENCY AND/OR TICKETING SERVICES PROVIDER (collectively “MANAGEMENT”) AND ALL OF THEIR OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, REPRESENTATIVES, AND AGENTS, FROM ANY AND ALL CLAIMS THAT THE USER HAS OR MAY HAVE THAT ARISE FROM OR ARE INCIDENTAL TO THE USE OF THE SERVICE, INCLUDING ANY CLAIMS ARISING OUT OF THE NEGLIGENCE OF MANAGEMENT OR MANAGEMENT’S OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, REPRESENTATIVES, OR AGENTS.

INDEMNIFICATION

You agree to indemnify and hold the Fries B4 Guys Parties harmless from any claim or demand, including reasonable attorney’s fees and costs, made by any third party due to or arising out of your posting of any content on our Digital Services, or other use of our Digital Services in a manner not permitted by these Terms of Use, including without limitation your actual or alleged violation of these Terms of Use, or infringement of a third party’s intellectual property or other rights by you or another user of our Digital Services using your computer, mobile device or account.

COPYRIGHT AND TRADEMARK INFORMATION

All content, copyrights and other intellectual property rights in the content available on our Digital Services, including without limitation design, text, graphics, interfaces, and the selection and arrangements thereof, are owned by Fries B4 Guys with all rights reserved. In some cases, such content may be licensed to Fries B4 Guys by third parties. This content is protected by the intellectual property rights of Fries B4 Guys or those owners. All content which qualifies for protection under U.S. Federal Copyright Law is subject to the exclusive jurisdiction of the Federal Court System, whether registered or unregistered. All trademarks displayed on our Digital Services are the trademarks of their respective owners and constitute neither an endorsement nor a recommendation of such parties. In addition, such use of trademarks or links to the websites of third parties is not intended to imply, directly or indirectly, that those third parties endorse or have any affiliation with Fries B4 Guys.

Indentification. 

You agree to indemnify, defend and hold us, our officers, our share holders, our partners, attorneys and employees harmless from any and all liability, loss, damages, claim and expense, including reasonable attorney’s fees, related to your violation of this Agreement or use of the Site

Fries B4 Guys strongly believes in both minimizing the data we collect and limiting its use and purpose to only that (1) for which the Company has been given permission, (2) as necessary to deliver the Services, or (3) as the Company might be required or permitted for legal compliance or other lawful purposes.

Use of Your Personally Identifiable Information. Once collected, the Company may use your Personally Identifiable Information in a variety of ways including, but not limited to: 

Provide service communications such as order confirmations, Sending your tickets, and customer service messages.

Respond to your emails or online requests for products, services, or information.

Processing your job application.

Fulfill and/or deliver the Services.

Communicate with you.

Detect and prevent fraud and abuse of our Services and systems.

To Law Enforcement if you commit a crime at our event.

THIRD-PARTY SERVICES

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.

However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions. For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers. In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located. As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act. Anti Hacking Policy

It is strictly prohibited for attendees and anyone else to engage in hacking activities targeting our website. Unauthorized access, penetration testing, or any form of hacking that compromises the security and integrity of our website is considered a serious violation of our policies and will not be tolerated under any circumstances.

Consequences: Any individual found to be involved in hacking our website will face immediate legal action, termination of any existing relationship with our organization, and may be held liable for damages caused. Furthermore, we reserve the right to report such activities to the relevant authorities for further investigation and potential prosecution.

Compliance: All employees, contractors, and third-party vendors are required to adhere to this policy and report any suspicious activities or security breaches immediately to the designated IT security team. Failure to comply with this policy may result in disciplinary action, up to and including termination of employment or contract.

Linking, Crawling, Framing

The Site and any content or resource viewed through it is available for your personal, private, and non-commercial use only. This includes, but is not limited to, information about Fries B4 Guys runs, race timings, finisher lists, etc.  You may link only to the Site’s home page, but not to any other page or portion of the Site. You agree not to, and warrant and represent that you will not assist any third-party in engaging in any activity or attempting in any way, to reproduce, in whole or in part, any content provided by the Site through any method (including, without limitation, through crawling, copying, caching, or framing), unless such access is expressly permitted in a written agreement executed by Fries B4 Guys. You may not, for instance, (a) incorporate the information, content, or other material in any database, compilation, archive, API or cache; (b) deep-link to the Site for any purpose; (c) access the Site manually or with any robot, spider, web crawler, extraction software, automated process, device, program, or algorithm to scrape, copy, or monitor any portion of the Site; (d) take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the Site; or (e) attempt to gain unauthorized access to any portion or feature of the Site by hacking, password mining, or any other illegitimate means. You agree not to use the Site, or any services made available through the Site for commercial purposes and agree not to share or transfer your account login information (if any) with any third party.  For avoidance of doubt, “commercial purposes” includes non-profit purposes.

VPN Use Policy

For security, fraud prevention, and identity verification purposes, the use of Virtual Private Networks (VPNs) is strictly prohibited when communicating with Fries B4 Guys staff or submitting any registration forms.

• Any emails transmitted through a VPN will be disregarded and will not receive a response.

• Any registration completed using a VPN will be automatically denied and considered invalid. No exceptions will be made.

All participants are required to use a verifiable, non-VPN internet connection for both communication and registration.

Ticket Scalping & Resale Policy 

1. Prohibition of Ticket Scalping

• Ticket scalping is strictly prohibited. This includes purchasing tickets with the intent to resell, transfer, or profitin any form. It applies to all attendees, third parties, or affiliates.

• Tickets purchased for the purpose of resale, barter, or compensation of any kind will be automatically voided.

2. Ticket Purchase Limits

• Tickets may be purchased in groups of up to 4 individuals per group and only 1 transaction allowed per groupunless explicit written permission is obtained from Fries B4 Guys in advance.

• Any attempt to exceed this limit without approval will result in cancellation of all affected tickets and possible permanent bans from all events.

3. Registration & Identity Verification

• All ticket holders must complete a full registration form with accurate legal name, age, and permanent home address.

• Names, addresses, and ages must match government-issued identification, including REAL ID if required.

• Registration forms must be submitted within the required timeframe (typically one week from purchase). Late or incomplete submissions result in automatic denial of entry.

• Each registrant is limited to one registration submission. Forms cannot be corrected after submission, and assistance must be requested before submitting.

4. Digital & Security Measures

• Fries B4 Guys employs digital audit trails and verification systems to detect ticket scalping, bulk purchases, VPN circumvention, and unauthorized resales.

• Any registration or ticket submission detected as fraudulent, duplicated, or suspicious will be investigated and immediately revoked if found in violation.

• Emails or forms submitted via VPNs or proxy servers will be automatically denied and ignored.

5. Enforcement & Consequences

• Tickets obtained or used in violation of this policy will be revoked without refund.

• Individuals violating this policy may be permanently banned from all current and future Fries B4 Guys events.

• Organized attempts to circumvent this policy may result in legal action, including civil claims, injunctions, or other remedies.

• Color Craze reserves the right to verify the identity of all ticket holders at entry. Failure to provide identification matching the registration will result in denied entry.

6. Non-Negotiable Policy

• This policy is strict and non-negotiable. No exceptions will be made for friends, family, third-party platforms, or any perceived special circumstance.

7. Attendee Acknowledgment

• By purchasing a ticket, attendees acknowledge that they understand and agree to comply fully with this policy. Violation is considered a material breach of event rules and is enforceable to the fullest extent permitted by law.

8. Official Fan-to-Fan Resale

• Tickets may only be resold through The  official Fan-to-Fan Exchange. Any resale attempts outside this platform are strictly prohibited and will be considered a violation of this policy.
